Intake Procedure:
Pick up Homestead Declaration at ESBC
Homeowner; for elderly/disabled protection, must be 62 yrs or older or disabled
Hours of Operation:
8:30am - 4:30pm M - F; recording hours 8:30am-3:59pm
Notes 1:
The Declaration of Homestead protects a person's principal place of residence from the claims of creditors to the extent of $500,000 so long as the person continues to occupy that residence. The Declaration is a simple form that is filled out and filed with the Registry of Deeds( in county of residence).
Notes 2:
There are two types of Homestead Declaration: *Regular- Allows owner to protect home up to $500,000 per residence/per family against force sale.*Elderly/Disabled- Allows owner to protect home up to $500,000 each owner from forced sale.
Notes 3:
Debt not protected by the Act: federal,state, local taxes, assessments, claims & liens; debts or contracts existing prior to the declaration; mortgages used to purchase the residence; Probate Court orders for spousal or child support.
